December 9, 1975 – Pier Avenue School appraised at $1,100,000.00 Pier Avenue School was eventually sold to the City of Hermosa Beach at 40% BELOW fair market value. The appraisal states that Pier Avenue school is a “physically sound” building. (TL-1975Dec9 PAS appraisal)
NOTE: Page 5 of the Memorandum of Understanding, Article 4, Section 4.02 states: “The nature of this memorandum of understanding shall be construed as being analogous to a lease in that a part of the consideration for the District selling the subject property to the City for less than fair market value is the District’s right to use the subject property facilities without cost as more particularly set forth below; and, conversely, a part of the consideration the City is giving to the District, is allowing the District use of the facilities at the subject property as more particularly set forth below.” (TL-1977Jun13 MOU Sec 4.02)

NOTE: The Hermosa Beach City Council had authorized negotiations for the purchase of Pier Avenue School for less than fair market value in January 1977, five months before accepting the final Memorandum of Understanding from HBCSD. The MOU prescribed the final negotiated terms by the city and the school district for future use of the Community Center by HBCSD.

1. “If an agreement is not reached by the board at tonight’s meeting, the whole deal (sale of Pier Avenue School to the city) is off.” Hermosa school superintendent Andrew Joyce told the school board at the beginning of last Tuesday’s meeting.”
2. “Two and a half hours later, after many frequently emotional exchanges between the board and members of the audience who were opposed to the sale of the school, the board tentatively settled upon conditions for the sale. February 28, 1978 – Agreement for Sale and Purchase of Real Property sent to Los Angeles County Recorder’s office. (aka Pier Avenue School, aka the Community Center) (TL-1978Feb28 entire PAS Agreement)
The main body of the Agreement is 11 pages (PAS Agreement pgs 1-11). The main 11 pages of the Agreement were an overall summarization of the entire agreement. The exhibits gave further information as to the intent and details and provisions of the agreement.
1. Article 1 Recital of Facts (page 2 of the Agreement) Section 1.09 (PAS Agreement Article 1, page 2) states: “A copy of the Resolution of the Intention of the District to sell the Pier Avenue School … Exhibit “G”.” This section is referring to the unsigned Resolution of Intention to Sell & Prescribing the terms there of and Exhibit B containing the escrow instructions and the MOU lease provisions.
2. Article 5 Conditions Precedent to Purchase (page 6 of the Agreement) Section 5.02 (PAS Agreement, Article 5, Section 2) states: “The execution by the parties of all the agreements attached hereto as exhibits, and …”
3. Article 6 Miscellaneous Conditions and Warranty (page 7 of the Agreement) Section 6.03 (PAS Misc Conditions pages 6&7) states: “The District warrants that it has the power and right to sell Pier Avenue School upon the terms and conditions set forth in this Agreement and all Agreements attached by Exhibits hereto and said warranty shall survive the closing of escrow.”

1. Proposition 13 (officially named the People's Initiative to Limit Property Taxation) is an amendment of the Constitution of California enacted during 1978, by means of the initiative process. The initiative was approved by California voters on June 6, 1978.
2. The most significant portion of the act is the first paragraph, which limits the tax rate for real estate:
Section 1. (a) The maximum amount of any ad valorem tax on real property shall not exceed one percent (1%) of the full cash value of such property. The one percent (1%) tax to be collected by the counties and apportioned according to law to the districts within the counties.
3. Effect on public schools
California's K-12 public schools, which during the 1960s had been ranked nationally as among the best, deteriorated substantially in many surveys of student achievement, according to a 2005 RAND study.[59] Some[60] disputed the attribution of the decline to Proposition 13's role in the change to state financing of public schools, because schools financed mostly by property taxes were declared unconstitutional (the variances in funding between lower and higher income areas being deemed to violate the Equal Protection Clause of the Fourteenth Amendment to the Constitution) in Serrano vs. Priest, and Proposition 13 was then passed partially as a result of that case.[55] California's spending per pupil was the same as the national average until about 1985, when it began decreasing, which resulted in another referendum, Proposition 98, that requires a certain percentage of the state's budget to be directed towards public education.
NOTE: The plan to sell Pier Avenue School was initiated in 1974 and had NOTHING to do with Proposition 13 as claimed by former city council member George Schmeltzer (1976-1984), HBCSD Superintendent Pat Escalante (2012-2020) and HBCSD attorney Terry Tao (2002-).
NOTE: Please see List of Lies, Lie #11: Claiming that the city purchased the Community Center from the school district because the school district needed money since Proposition 13 had decimated district funding in the 1970s.
